1. Introduction

Welcome to XclusiveMe operated by SMMD E.I.R.L. "us", "we", or "our"). These Terms of Service ("Terms") govern your use of our App available on App Store Connect, and any related services provided by us.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

2. Accounts

If you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with our App or a third-party service.

3. XclusiveMe Standards Against Child Sexual Abuse and Exploitation (CSAE)

3.1. Zero Tolerance Policy

XclusiveMe has a zero-tolerance policy for any form of Child Sexual Abuse and Exploitation (CSAE). Any user found engaging in, promoting, or facilitating CSAE will be permanently banned and reported to appropriate law enforcement agencies without exception.

3.2. Definitions

  • Child: Any person under the age of 18, in line with the UN Convention on the Rights of the Child (UNCRC).

  • CSAE: Includes any form of sexual abuse, exploitation, grooming, trafficking, or any sexualized representation (real or simulated) of minors.

  • Sexualized Content: Any material that depicts a minor (real, simulated, drawn, or AI-generated) in a sexual context, or content encouraging sexualization of minors.

3.3. Prohibited Content

  • Strictly prohibited content includes, but is not limited to:

  • Images, videos, or media depicting CSAE (real or simulated).

  • Nude or sexually suggestive content of minors, including fictional, artistic, AI-generated, or drawn material.

  • Any media that sexualizes children (including “teen fetish” categories).

  • Grooming behaviors: attempts to establish inappropriate relationships with minors.

  • Luring or soliciting minors for sexual purposes.

  • Content encouraging or instructing CSAE practices.

  • Hidden, encrypted, or misleading tags to bypass detection filters.

3.4. Platform-Wide Safety Controls

3.4.1. Age Verification

  • Strict 18+ age verification is mandatory for all content creators that seem to be under the age of 21, using government-issued IDs.

  • Regular verification audits will be conducted for accuracy.

3.4.2. Upload Moderation

  • Every upload undergoes manual moderation, a human review for CSAE content indicators before becoming public.

  • All flagged content will be reviewed by trained CSAE moderation specialists within 24 hours.

3.4.3. Chat & Interaction Safety

  • Private messages are monitored via pattern detection for grooming behavior.

  • Suspicious phrases trigger automated review and potential account suspension pending investigation.

3.5. Reporting & Response Protocol

  • Any user can report suspected CSAE content via a dedicated, easy-to-access reporting tool.

  • Reports involving CSAE receive top-priority escalation, with internal review initiated within 12 hours.

  • Confirmed CSAE cases lead to immediate law enforcement notification, account termination, and data preservation for legal purposes.

3.6. Cooperation with Authorities

  • XclusiveMe fully cooperates with law enforcement globally in investigations of CSAE.

  • We respond promptly to valid requests from INTERPOL, NCMEC, Europol, and other official child protection agencies.

3.7. Transparency & Accountability

  • We have bi-annual Transparency Reports outlining:

    • Number of CSAE reports

    • Content removal actions

    • Cooperation with legal authorities

  • Regular audits by child protection organizations will be welcomed to enhance our response systems.

3.8. Training & Awareness

  • All employees and moderators undergo mandatory CSAE identification and response training.

  • Creators are required to accept the CSAE Policy Agreement before uploading, which includes educational material on prohibited content.

3.9. Regular Policy Review

  • This standard is reviewed and updated every 6 months and we will consult and cooperate with:

    • International child protection organizations (e.g., ECPAT, NCMEC)

    • Industry best practices

    • Community feedback

4. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of SMMD E.I.R.L. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of

Our App may contain links to third-party web sites or services that are not owned or controlled by SMMD E.I.R.L..

SMMD E.I.R.L. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SMMD E.I.R.L. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.

7. Limitation of Liability

In no event shall SMMD E.I.R.L., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

(i) your access to or use of or inability to access or use the App;

(ii) any conduct or content of any third party on the App;

(iii) any content obtained from the App; and

(iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Peru, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
